KIPO opens the web site dedicated to patent examination guideline
Examination Standard on Patent requirements in English is also provided
The KIPO(commissioner: JungSig Koh) announced it had built and opened on January 1st the web site dedicated to patent examination guideline (http://www.kipo.go.kr/patguideline) in the KIPO home page to enhance the clearance and transparency of patent examination practice and to provide the clients with more opportunities of participation.
The web site is going to provide itemized examples of application, the cases of the Supreme Court and Patent Court, and the guidelines of the advanced countries’ patent system such as the US and Japan along with their representative cases as well as those of Korea, enhancing the understanding of the examination guidelines.
It is expected to satisfy the foreign clients who have been curious about Korean patent examination practice as the web site could give the answers for their questions. The patent examination guideline for patent requirements was first translated into English after the KIPO had established and any one could download and make use of it from the site, said an official in the KIPO. The English patent examination guideline is expected to be effectively used as a valuable material in publicly advertizing Korean advanced IP administration.
The web site has been under construction along with a revision of the standard of patent allowance to improve the clearance of patent procedures, drawing much attention from the academic and industry world.
According to the KIPO, the standard of decision on the inventive step of an invention is greatly changed in the revision and the allowance of granting patents has become more specific and clear through the addition of over 40 patent guidelines including that of parameter invention which has been achieved by comparison and analysis of the advanced countries’ guidelines, thereby meet the ongoing international harmonization of patent examination guidelines.
