The fees paid to the KIPO for the accelerated examination have reached 7.6 billion won in the last 3 years. The accelerated examination is an examination system to advance the order of examination through additional fee even when the request for examination has been filed late.
According to the ‘status of tax revenue on the accelerated examination fee’ submitted to Taewhan Kim, a member of Knowledge Economy Committee, the collected fees for the accelerated examination have increased every year with 1.97 billion won in 2007, 2.5 billion won in 2008 and 3.1 billion won in 2009, totaling 7.58 billion won for 3 years.
‘Accelerated examinations’, which have been only allowed for the patent applications on defense industry, green technologies or for export enhancement, have sharply increased since on October 2008, the KIPO changed the examination system from the one in which examination period is reduced uniformly over all application to the customized 3track examination system (accelerated examination, regular examination, belated examination). Meanwhile, the rate of the request for regular examinations decreased by 10.2% from 91.1% in 2007 to 80.9% last year.
According to Mr. Kim, the applicant who requests accelerated examination should pay the fee in the amount of 167.000 won to the KIPO in addition to the regular examination fee, and entrust a prior art search to one of 4 agencies designated by the KIPO, which costs 500,000 to 600,000 won.
Considering the current situation that applicants are obliged to request accelerated examination with high costs, it is necessary to improve examination system by assigning those exclusively responsible for the accelerated examination and limiting the rate of the request for the accelerated examination, said Mr. Kim.
